The fiscal cliff, and its implications for the U.S. economy, may be receiving all the attention from the media, but the National Association of Realtors (NAR) is doing its darnedest to ensure that another, equally potent piece of legislation receives some attention – the Mortgage Forgiveness Debt Relief Act, which is set to expire on Dec. 31.
One of the more effective pieces of legislation passed by Congress during the economic downturn, the Mortgage Forgiveness Debt Relief Act did exactly what its name suggets, in excluding the forgiven debts from taxable income when the owner short sells his or her property.
Mortgage Forgiveness Debt Relief Act
The expiration of the Mortgage Forgiveness Debt Relief Act has been on housing’s radar since the start of the year, and for good measure – it can have a remarkable impact on incentivizing delinquent homeowners to pursue short sales:
- For instance, assume a homeowner engages in a short sale on a primary residence, and because he/she pursued a short sale, the bank forgives the $50,000 of mortgage debt that is still owed after the transaction.
- With the Mortgage Forgiveness Debt Relief Act in place, that $50,000 is exempt from taxable income, and the IRS will not tax the funds.
- The essence of the Act is enough to warrant support among the Realtor community, but the nature of distressed property sales has launched that support into overdrive. Distressed property sales are notorious for taking a long time to complete, and should the Mortgage Forgiveness Debt Relief Act expire at the end of the year, there could be numerous owners of delinquent properties who began the short sale process in June or July counting on its measures.
Jodi Macken, a principal at Macken Realty in Miami Beach, said that not only will the expiration of the Mortgage Forgiveness Debt Relief Act have an negative impact on real estate, but she’s not happy about it.
“I’ve actually very upset,” Macken said. “It had been so helpful in getting us out of that dark hole.”
The “dark hole” Macken refers to is the vicious cycle of vacant REO properties that sat on the Miami marketplace for months, lowering home values and damaging communities. The Act, though, had incentivized delinquent borrowers to pursue short sales, and less and less homes were sitting vacant; now, though, that process is in danger of occurring all over again, should the act not be renewed.
Chances for Renewal?
So with all that in mind, what are the chances for renewal? Syndicated columnist Kenneth R. Harney has written that there is a pending bill from the Senate Finance Committee and “at least” four bills in the House that would extend the act anywhere from one year to three, though no news has broken on their passage – which is a shame, given what’s at stake.
“It’s enormously important that we support this legislation,” NAR President Moe Veissi said in a video to members. “This is a vital, important message not just for our community of Realtors, but for the American consumer.”
