Court upholds South Florida brokerage’s noncompete clause with former agent

A South Florida owner-broker won a court injunction against a former agent that the brokerage claims broke her noncompete clause, according to reports.

Signature Real Estate Cos, and its owner Ben Schachter, sued former agent Shelly Gibson after she left his Kings Point office and began marketing properties within the same retirement community west of Delray Beach, according to the Palm Beach Report.

Schachter filed suit after claiming that his former employee violated a noncompete, which stipulated she could not work in any of the retirement communities that Signature Real Estate services for two years.

In late 2017, Gibson left Signature to form her own company and immediately began marketing over two dozen properties in Kings Point. Schachter then filed suit, saying his former agent working in the retirement negatively impacted his investment in the area.

Gibson claimed in a deposition that she was treated poorly by her former employer, and a lawyer for Gibson told the Palm Beach Post that Schachter treated his agents as “indentured servants.”
